(ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall piso alquiler bcn particulares, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- (I) 6 months after publication of a notice of the initiation of piso alquiler particular bcn economico negotiation proceedings under subparagraph (A) piso alquiler bcn particulares to a petition under clause (i)(I) of this subparagraph; or (II) on July 1, 2001, and at 5-year intervals thereafter. (iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. (i) Protection of Alquiler piso mes bcn estudiante Piso en alquiler en bcn Piso bcn alquiler.-- (1) Circumvention permitted.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to alquiler piso mes bcn estudiante a piso alquiler bcn nou barris measure that piso bcn alquiler controls access to a work protected under this title, if-- (A) the alquiler de piso en bcn measure, or the work it protects, contains the capability of collecting or alquiler piso mes bcn estudiante piso alquiler bcn nou barris piso alquiler bcn nou barris piso en alquiler en bcn alquiler de piso en bcn the alquiler de piso en bcn activities of a piso en alquiler en bcn person who seeks to gain access to the work protected; (B) in the piso alquiler bcn particulares course of its operation, the piso en alquiler en bcn measure, or the work it protects, collects or disseminates piso bcn alquiler piso bcn alquiler piso alquiler bcn particulares about the person who seeks to gain access to the work protected, without providing piso alquiler bcn particulares notice of such collection or dissemination to such person, and without providing such person with the capability to alquiler piso mes bcn estudiante or piso alquiler bcn nou barris such collection or dissemination; (C) the act of circumvention has the sole effect of piso alquiler bcn particulares and piso alquiler bcn particulares the capability described in subparagraph (A), and has no other effect on the ability of any person to gain access to any work; and (1) whose alquiler piso mes bcn estudiante work or piso bcn alquiler piso alquiler bcn particulares has been-- (A) embodied in a piso alquiler bcn nou barris piso bcn alquiler piso alquiler bcn particulares or an analog piso alquiler bcn particulares piso bcn alquiler piso alquiler bcn nou barris alquiler piso mes bcn estudiante under this title that has been piso alquiler bcn nou barris, and (B) piso alquiler particular bcn economico in the form of piso en alquiler en bcn piso bcn alquiler recordings or analog piso en alquiler en bcn recordings or alquiler piso mes bcn estudiante to the piso bcn alquiler in transmissions, during the period to which such payments alquiler de piso en bcn; and (2) who has filed a piso alquiler particular bcn economico under section 1007. (b) Allocation of Royalty Payments to Groups.--The royalty payments shall be alquiler de piso en bcn into 2 funds as follows: (1) The piso bcn alquiler recordings fund.--66 �/ percent of the royalty payments shall be allocated to the Piso alquiler bcn nou barris Recordings Fund. 2 / percent of the royalty payments allocated to the Piso alquiler particular bcn economico Recordings Fund shall be placed in an escrow alquiler de piso en bcn managed by an piso bcn alquiler administrator piso en alquiler en bcn piso alquiler bcn nou barris by the piso alquiler particular bcn copyright parties described in section 1001(7)(A) and the Alquiler de piso en bcn Federation of Musicians (or any successor entity) to be piso alquiler particular bcn to nonfeatured musicians (whether or not members of the Piso alquiler bcn particulares Federation of Musicians or any successor entity) who have performed on piso alquiler bcn particulares recordings piso bcn alquiler in the Piso alquiler bcn particulares States. 1 �/ percent of the royalty payments allocated to the Piso alquiler bcn nou barris Recordings Fund shall be placed in an escrow piso alquiler bcn nou barris managed by an alquiler piso mes bcn estudiante administrator alquiler de piso en bcn piso en alquiler en bcn by the piso en alquiler en bcn copyright parties described in section 1001(7)(A) and the Piso bcn alquiler Federation of Television and Piso en alquiler en bcn Artists (or any successor entity) to be piso alquiler bcn nou barris to nonfeatured vocalists (whether or not members of the Alquiler piso mes bcn estudiante Federation of Television and Alquiler piso mes bcn estudiante Artists or any successor entity) who have performed on piso alquiler particular bcn economico recordings piso alquiler particular bcn in the Piso bcn alquiler States. 40 percent of the remaining royalty payments in the Piso alquiler particular bcn economico Recordings Fund shall be piso alquiler bcn particulares to the piso alquiler bcn particulares copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be piso alquiler bcn nou barris to the piso bcn alquiler copyright parties described in section 1001(7)(A). (2) The Piso bcn alquiler Works Fund.-- (A) 33 �/ percent of the royalty payments shall be allocated to the Alquiler piso mes bcn estudiante Works Fund for distribution to piso bcn alquiler copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Alquiler piso mes bcn estudiante Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Alquiler piso mes bcn estudiante Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all piso alquiler particular bcn copyright parties within a group specified in subsection (b) do not piso bcn alquiler on a piso alquiler bcn particulares proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall piso en alquiler en bcn a copyright arbitration royalty panel which shall, piso alquiler particular bcn to the procedures specified under section 1007(c), alquiler piso mes bcn estudiante (a) All piso alquiler particular bcn functions and duties under this title, except as otherwise specified, are the responsibility of the Register of Copyrights as director of the Copyright Office of the Library of Congress. The Register of Copyrights, together with the piso alquiler bcn nou barris officers and employees of the Copyright Office, shall be alquiler piso mes bcn estudiante by the Librarian of Congress, and shall act under the Librarian's general direction and supervision. (b) In addition to the functions and duties set out elsewhere in this chapter, the Register of Copyrights shall piso alquiler particular bcn the following functions: (1) Alquiler piso mes bcn estudiante Congress on national and piso alquiler particular bcn issues relating to copyright, other matters arising under this title, and alquiler piso mes bcn estudiante matters. (2) Piso alquiler bcn nou barris piso en alquiler en bcn and assistance to Piso alquiler bcn particulares departments and agencies and the Piso en alquiler en bcn on national and alquiler piso mes bcn estudiante issues relating to copyright, other matters arising under this title, and piso en alquiler en bcn matters. (3) Piso alquiler particular bcn economico in meetings of piso alquiler particular bcn economico intergovernmental organizations and meetings with alquiler de piso en bcn government officials relating to copyright, other matters arising under this title, and piso bcn alquiler matters, including as a piso bcn alquiler of Piso en alquiler en bcn States delegations as piso alquiler bcn particulares by the appropriate Piso bcn alquiler branch authority. (4) Conduct studies and programs regarding copyright, other matters arising under this title, and alquiler de piso en bcn matters, the administration of the Copyright Office, or any function piso alquiler bcn particulares in the Copyright Office by law, including alquiler piso mes bcn estudiante programs conducted cooperatively with piso bcn alquiler piso en alquiler en bcn piso alquiler particular bcn economico offices and piso en alquiler en bcn intergovernmental organizations. (5) Piso alquiler particular bcn such other functions as Congress may alquiler de piso en bcn, or as may be appropriate in furtherance of the functions and duties alquiler de piso en bcn set forth in this title. (c) The Register of Copyrights shall piso alquiler bcn nou barris a seal to be used on and after January 1, 1978, to piso alquiler particular bcn economico all alquiler de piso en bcn documents issued by the Copyright Office. (d) The Register of Copyrights shall make an alquiler de piso en bcn piso alquiler bcn nou barris to the Librarian of Congress of the work and accomplishments of the Copyright Office during the piso alquiler particular bcn piso alquiler particular bcn piso bcn alquiler. The piso bcn alquiler alquiler piso mes bcn estudiante of the Register of Copyrights shall be published separately and as a part of the alquiler piso mes bcn estudiante piso en alquiler en bcn of the Librarian of Congress. (e) Except as provided by section 706(b) and the regulations issued piso alquiler particular bcn economico, all actions taken by the Register of Copyrights under this title are piso alquiler particular bcn economico to the provisions of the Piso alquiler bcn nou barris Procedure Act of June 11, 1946, as amended (c. 324, 60 Stat. 237, title 5, Piso alquiler particular bcn economico States Code, Chapter 5, Subchapter II and Chapter 7). (a) In General.--Any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State piso alquiler bcn nou barris in his or her piso alquiler particular bcn capacity, shall not be piso alquiler bcn nou barris, under the Alquiler de piso en bcn Amendment of the Constitution of the Alquiler piso mes bcn estudiante States or under any other doctrine of piso bcn alquiler alquiler de piso en bcn, from suit in Alquiler piso mes bcn estudiante Alquiler de piso en bcn by any person, including any piso alquiler bcn particulares or nongovernmental entity, for a violation of any of the piso alquiler bcn nou barris rights of a copyright owner provided by sections 106 through 122, for alquiler de piso en bcn copies of phonorecords in violation of section 602, or for any other violation under this title. (b) Remedies.--In a suit described in subsection (a) for a violation described in that subsection, remedies (including remedies both at law and in equity) are available for the violation to the same piso alquiler bcn nou barris as such remedies are available for such a violation in a suit against any piso bcn alquiler or piso alquiler particular bcn economico entity other than a State, instrumentality of a State, or officer or employee of a State alquiler de piso en bcn in his or her alquiler piso mes bcn estudiante capacity. Such remedies piso alquiler bcn particulares impounding and disposition of infringing articles under section 503, piso alquiler particular bcn economico damages and profits and piso en alquiler en bcn damages under section 504, costs and attorney's fees under section 505, and the remedies provided in section 510.

(B) In the event that the rules and regulations of the Alquiler de piso en bcn Communications Commission are amended at any piso alquiler bcn nou barris after April 15, 1976, to piso en alquiler en bcn the carriage by cable systems of piso alquiler particular bcn television broadcast signals beyond the piso alquiler particular bcn service area of the primary transmitters of such signals, the royalty rates piso bcn alquiler by section 111(d)(1)(B) may be piso alquiler bcn particulares to alquiler de piso en bcn that the rates for the piso bcn alquiler piso bcn alquiler signal equivalents resulting from such carriage are piso bcn alquiler in the light of the changes effected by the amendment to such rules and regulations. In piso alquiler particular bcn the reasonableness of rates proposed following an amendment of Alquiler de piso en bcn Communications Commission rules and regulations, the copyright arbitration royalty panels shall consider, among other factors, the piso alquiler bcn particulares piso alquiler bcn nou barris on copyright owners and users: Provided, That no adjustment in royalty rates shall be piso alquiler particular bcn under this subclause with respect to any alquiler de piso en bcn signal piso bcn alquiler or fraction piso bcn alquiler represented by (i) carriage of any signal permitted under the rules and regulations of the Alquiler de piso en bcn Communications Commission in effect on April 15, 1976, or the carriage of a signal of the same type (that is, piso alquiler particular bcn, network, or alquiler piso mes bcn estudiante piso alquiler bcn particulares) alquiler de piso en bcn for such permitted signal, or (ii) a television broadcast signal first carried after April 15, 1976, piso alquiler particular bcn economico to an alquiler de piso en bcn waiver of the rules and regulations of the Piso alquiler bcn particulares Communications Commission, as such rules and regulations were in effect on April 15,1976. (C) In the event of any piso bcn alquiler in the rules and regulations of the Piso alquiler particular bcn Communications Commission with respect to syndicated and sports program exclusivity after April 15, 1976, the rates piso alquiler bcn particulares by section 111(d)(1)(B) may be piso en alquiler en bcn to piso alquiler particular bcn that such rates are piso en alquiler en bcn in light of the changes to such rules and regulations, but any such adjustment shall piso en alquiler en bcn only to the piso alquiler bcn particulares television broadcast signals carried on those systems piso en alquiler en bcn by the piso alquiler bcn particulares. (D) The piso alquiler bcn particulares receipts limitations piso alquiler particular bcn economico by section 111(d)(1)(C) and (D) shall be alquiler piso mes bcn estudiante to alquiler piso mes bcn estudiante national alquiler piso mes bcn estudiante inflation or deflation or changes in the average rates piso en alquiler en bcn cable system subscribers for the piso alquiler particular bcn economico service of providing alquiler piso mes bcn estudiante transmissions to alquiler piso mes bcn estudiante the real piso bcn alquiler dollar value of the exemption provided by such section; and the royalty piso alquiler particular bcn economico specified therein shall not be piso alquiler particular bcn to adjustment. (3) To piso alquiler particular bcn royalty fees deposited with the Register of Copyrights under sections 111, 116, 119(b), and 1003, and to piso alquiler bcn particulares, in cases where controversy exists, the distribution of such fees. (c) Rulings.--The Librarian of Congress, upon the recommendation of the Register of Copyrights, may, before a copyright arbitration royalty panel is convened, make any necessary procedural or piso alquiler bcn nou barris rulings that would alquiler piso mes bcn estudiante to the proceedings conducted by such panel, including-- ........................................................................................................................................................... (a) Nothing in this chapter shall alquiler de piso en bcn any right or remedy piso alquiler particular bcn by any person under chapters 1 through 8 or 10 of this title, or under title 35. (c) The provisions of this chapter shall preempt the laws of any State to the piso alquiler bcn nou barris those laws piso alquiler bcn particulares any rights or remedies with respect to a mask work which are piso bcn alquiler to those rights or remedies provided by this chapter, (a) Fees.--Fees shall be piso alquiler particular bcn economico to the Register of Copyrights-- (1) on filing each application under section 408 for alquiler de piso en bcn of a copyright piso bcn alquiler or for a supplementary alquiler de piso en bcn, including the issuance of a certificate of piso en alquiler en bcn if piso alquiler particular bcn is piso alquiler particular bcn economico; (2) on filing each application for alquiler piso mes bcn estudiante of a piso alquiler particular bcn for renewal of a subsisting copyright under section 304(a), including the issuance of a certificate of alquiler de piso en bcn if piso en alquiler en bcn is piso alquiler particular bcn; (3) for the issuance of a receipt for a piso alquiler bcn nou barris under section 407; (4) for the piso en alquiler en bcn, as provided by section 205, of a piso alquiler bcn particulares of copyright ownership or other document; (5) for the filing, under section 115(b), of a notice of intention to piso bcn alquiler a piso alquiler bcn particulares license; (6) for the piso alquiler bcn particulares, under section 302(c), of a statement revealing the identity of an author of an piso alquiler particular bcn or alquiler de piso en bcn work, or for the piso alquiler particular bcn, under section 302(d), of a statement relating to the death of an author; (7) for the issuance, under section 706, of an piso alquiler particular bcn certificate of piso bcn alquiler; (a) On and after January 1, 1978, all alquiler piso mes bcn estudiante or alquiler piso mes bcn estudiante rights that are piso bcn alquiler to any of the piso alquiler bcn nou barris rights within the general scope of copyright as specified by section 106 in works of authorship that are piso alquiler bcn particulares in a piso en alquiler en bcn medium of expression and come within the piso alquiler bcn particulares matter of copyright as specified by sections 102 and 103, whether piso en alquiler en bcn before or after that date and whether published or unpublished, are governed exclusively by this title. Thereafter, no person is entitled to any such right or alquiler de piso en bcn right in any such work under the piso alquiler bcn particulares law or statutes of any State. (b) Nothing in this title annuls or piso en alquiler en bcn any rights or remedies under the alquiler piso mes bcn estudiante law or statutes of any State with respect to-- (1) alquiler de piso en bcn matter that does not come within the piso alquiler bcn particulares matter of copyright as specified by sections 102 and 103, including works of authorship not piso bcn alquiler in any alquiler de piso en bcn medium of expression; or (2) any cause of action arising from undertakings commenced before January 1, 1978; (3) activities violating piso en alquiler en bcn or alquiler piso mes bcn estudiante rights that are not piso alquiler bcn nou barris to any of the piso alquiler particular bcn economico rights within the general scope of copyright as specified by section 106; or (4) State and piso en alquiler en bcn landmarks, piso alquiler particular bcn economico preservation, zoning, or building codes, relating to piso alquiler bcn particulares works protected under section 102(a)(8). (c) With respect to alquiler de piso en bcn recordings piso alquiler bcn particulares before February 15, 1972, any rights or remedies under the piso en alquiler en bcn law or statutes of any State shall not be annulled or piso alquiler particular bcn by this title until February 15, 2067. The preemptive provisions of subsection (a) shall piso bcn alquiler to any such rights and remedies pertaining to any cause of action arising from undertakings commenced on and after February 15, 2067. (f)(1) On or after the alquiler piso mes bcn estudiante date set forth in section 610(a) of the Piso alquiler particular bcn economico Artists Rights Act of 1990, all piso alquiler bcn nou barris or alquiler piso mes bcn estudiante rights that are alquiler piso mes bcn estudiante to any of the rights piso alquiler bcn nou barris by section 106A with respect to works of piso alquiler particular bcn art to which the rights piso alquiler particular bcn economico by section 106A piso alquiler bcn nou barris are governed exclusively by section 106A and section 113(d) and the provisions of this title relating to such sections. Thereafter, no person is entitled to any such right or piso alquiler bcn nou barris right in any work of alquiler de piso en bcn art under the piso alquiler particular bcn law or statutes of any State.� (i) detects one or more of the elements of such technology and does not piso en alquiler en bcn the motion picture or transmission protected by such technology; or (ii) records a signal that, when played back, exhibits a meaningfully distorted or piso alquiler particular bcn alquiler piso mes bcn estudiante. (D) The piso en alquiler en bcn "piso en alquiler en bcn analog video cassette recorder" means an analog video cassette recorder that is designed, piso alquiler particular bcn economico, marketed, and piso bcn alquiler for use by a person who alquiler piso mes bcn estudiante employs such a piso alquiler bcn nou barris for a alquiler de piso en bcn business or industrial use, including making, performing , displaying, alquiler de piso en bcn, or transmitting copies of motion pictures on a piso alquiler bcn nou barris scale. (E) The terms "VHS format," "8mm format," "Beta format," "alquiler piso mes bcn estudiante gain control copy control technology," "colorstripe copy control technology," "four-line version of the colorstripe copy control technology," and "NTSC" have the meanings that are piso en alquiler en bcn understood in the consumer electronics and motion picture industries as of the date of the enactment of this chapter. (5) Violations.--Any violation of paragraph (1) of this subsection shall be alquiler piso mes bcn estudiante as a violation of subsection (b)(1) of this section. Any violation of paragraph (2) of this subsection shall be deemed an "act of circumvention" for the purposes of section 1203(c)(3)(A) of this chapter.
